Warranty, Disclaimer and Limitation: ALL SERVICES HEREUNDER ARE PROVIDED ON AN "AS IS" BASIS, AND CUSTOMER'S OR ITS END USERS' USE THEREOF IS AT SUCH PARTIES' OWN RISK. RLN DOES NOT MAKE, AND HEREBY DISCLAIMS, ANY AND ALL OTHER EXPRESS AND IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT AND TITLE, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. In addition to, but not in limitation of, the above disclaimer neither RLN nor its suppliers shall have any liability under any provision of this Agreement with respect to any performance problem, claim of infringement or other matter to the extent attributable to (a) any unauthorized or improper use or modification of Services by a party other than RLN, its subcontractors or agents; (b)any erroneous direction given and/of information supplied by Customer’s IT or other designated representative; and (c)any breach of this Agreement or service request. RLN shall use reasonable efforts under the circumstances to maintain overall network quality. MAKES NO OTHER WARRANTIES ABOUT THE SERVICE PROVIDED HEREUNDER, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE. Customer’s sole recourse shall be for any alleged breach of warranty relating to the services shall be the re-performance of the services. IN NO EVENT SHALL RLN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, EXEMPLARY, SPECIAL, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT OR SERVICE REQUEST. THE EXTENT OF ANY MONETARY DAMAGES SHAL BE LIMITED TO THE SUM OF ALL FEES PAID BY CUSTOMER TO RLN PURSUANT TO THIS AGREEMENT OR SERVICE REQUEST.
